Estate and Trust Administration

FMH attorneys guide fiduciaries and beneficiaries through the administration of significant and complex estates and trusts.

We prepare and file the appropriate forms and tax returns with the IRS, such as estate (Form 706) and gift tax returns (Form 709).

Fiduciaries can be put in the position of having to resolve complex and uncertain tax issues in the administration, such as prior incorrect tax returns, unfiled tax returns, or undisclosed foreign financial assets.  The decedent might also have tax or other federal debts that exceed the value of the assets in the estate.  In some instances, federal law can impose personal liability on the fiduciary if these issues are not addressed correctly.  We help fiduciaries navigate these challenges.

Our attorneys have represented clients in estate and gift tax controversy matters with the IRS and leverage that experience in crafting a comprehensive estate administration plan with an objective of mitigating later disputes with the IRS.
